1. Acceptance of these terms

By downloading, installing, or using Naymsake (名字有料, "the App"), you agree to these Terms of Use ("Terms"). If you do not agree, do not use the App. These Terms form a legal agreement between you and TechnicolorLife LLC ("TechnicolorLife," "we," "us"). They are separate from, and in addition to, Apple's Licensed Application End User License Agreement, which also governs your use of the App as described in Section 12 below.

2. What Naymsake is

Naymsake is an entertainment and reference app for Traditional-Chinese speakers. It describes how common English names are perceived by native English speakers — generational feel, social register, memes, and pronunciation — and offers a Chinese-to-English generational name cross-reference, name pronunciation, and a feature to turn a name card into a shareable image. The App has no account and (at launch) no advertising, in-app purchases, or communication features.

3. Entertainment content disclaimer

The App's descriptions of how names are "perceived," their generational associations, memes, social register, trivia, and Chinese-to-English cross-references are provided for entertainment and general-interest purposes only. They reflect generalized cultural impressions and our editorial judgment, are inherently subjective, vary by region and audience, and change over time. They are not advice about what you should name yourself, your child, your business, or anyone else, and are not a statement of fact about any individual who bears a given name. Generational and popularity information is based on public United States naming data and may not reflect other countries or current trends. While we strive for accuracy and good taste, we do not warrant that any content is complete, current, or error-free, and you should not rely on the App as an authoritative reference.

4. Eligibility

The App is a general-audience app and is not directed to children under 13. By using the App you represent that you are old enough to form a binding agreement in your jurisdiction, or that a parent or legal guardian agrees to these Terms on your behalf. The App requires no account and collects no personal information; see the Privacy Policy for details.

5. Your data

Your favorites and search history are stored locally on the device and belong to you. TechnicolorLife does not claim ownership of them and has no access to them. Uninstalling the App deletes them.

6. Acceptable use

You agree to use the App only for its intended purpose as a personal entertainment and reference tool. You agree not to:

  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App, except to the extent applicable law expressly prohibits such restriction.
  • Copy, modify, redistribute, sublicense, sell, rent, or lease the App or any substantial part of it, including its curated name dataset, text, and artwork.
  • Use the App or its content to harass, demean, or discriminate against any person or group, including on the basis of their name, ethnicity, age, or national origin.
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notice.
  • Use the App in any way that violates applicable local, state, national, or international law.

7. Intellectual property

The App, including its design, code, graphics, curated editorial content, text, and logo, is the property of TechnicolorLife LLC and is protected by copyright, trademark, and other intellectual property laws. Underlying name-popularity statistics are derived from public United States Social Security Administration data, which is in the public domain; our selection, wording, and presentation of that data are our own. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, solely for personal, non-commercial use, subject to these Terms and the Apple Licensed Application EULA.

8. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, TECHNICOLORLIFE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE APP WILL BE ERROR-FREE, SECURE, ACCURATE, RELIABLE, OR UNINTERRUPTED. YOU USE THE APP AT YOUR OWN RISK.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TECHNICOLORLIFE LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT TECHNICOLORLIFE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions our liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless TechnicolorLife LLC and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the App; (b) your violation of these Terms; or (c) your violation of any law or the rights of a third party.

11. Termination

You may stop using the App at any time by uninstalling it from the device. Because the App is local-first and has no account, there is no account for us to close — uninstalling deletes the locally stored favorites and searches. We may suspend or discontinue the App, or any feature of it, at any time, including for users who violate these Terms.

12. Apple-specific terms

The following provisions apply to your use of the App on Apple devices and are required by Apple:

  • Acknowledgment. These Terms are entered into between you and TechnicolorLife LLC only, and not with Apple Inc. ("Apple"). TechnicolorLife, not Apple, is solely responsible for the App and its content.
  • Scope of license. The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in Apple's App Store Terms of Service.
  • Maintenance and support. TechnicolorLife is solely responsible for providing any maintenance and support services for the App. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
  • Warranty. TechnicolorLife is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the App to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
  • Product claims. TechnicolorLife, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
  • Intellectual property. In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, TechnicolorLife, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
  • Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Developer contact information. Questions, complaints, or claims regarding the App should be directed to: contact@technicolorlife.app.
  • Third-party beneficiary. You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

13. Export controls

You agree to comply with all U.S. and foreign export laws and regulations to ensure that neither the App nor any technical data related to it is exported or re-exported directly or indirectly in violation of, or used for any purposes prohibited by, such laws and regulations.

14. Governing law

These Terms are governed by the laws of the United States. Any dispute arising out of or relating to these Terms or the App shall be resolved in accordance with applicable law.

15. Severability and entire agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy and the Apple Licensed Application EULA, constitute the entire agreement between you and TechnicolorLife regarding the App.

16. Changes to these Terms

We may update these Terms over time. When we do, we will update the "Last updated" date at the top of this page. If we make material changes, we will give clear notice on technicolorlife.com before they take effect. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
