1. Acceptance of these terms

By downloading, installing, or using Amberly ("the App"), you agree to these Terms of Use ("Terms"). If you do not agree, do not use the App. These Terms form a legal agreement between you and TechnicolorLife LLC ("TechnicolorLife," "we," "us"). They are separate from, and in addition to, Apple's Licensed Application End User License Agreement, which also governs your use of the App as described in Section 14 below.

2. What Amberly is

Amberly is a personal seizure diary for people with epilepsy and their caregivers. It helps you log seizure events, capture context, and prepare summaries to share with your neurologist, caregiver, or care team. Amberly is made by TechnicolorLife LLC.

3. Not a medical device

Amberly is not a medical device. It does not diagnose, treat, cure, or prevent any disease or medical condition, and it has not been evaluated by the U.S. Food and Drug Administration or any equivalent regulator. The App does not replace professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you have about a medical condition. Never disregard professional medical advice, or delay seeking it, because of something you read or logged in Amberly.

4. Not a monitoring or emergency service

Amberly does not automatically notify anyone when you log a seizure. It is a personal tracking tool, not a monitoring, alerting, or emergency dispatch system. The App will not contact your caregiver, your family, your doctor, or emergency services on your behalf.

If you are experiencing a medical emergency, call your local emergency number (911 in the United States) immediately. Do not rely on the App to contact emergency services for you.

5. Eligibility and age

You must be at least 13 years old to use Amberly. If you are under the age of 16 and live in the European Economic Area or the United Kingdom, you represent that you have the consent of a parent or legal guardian to use the App. A parent or legal guardian may also use Amberly to log and track seizures on behalf of a child in their care.

6. Your data and your account

You own the data you enter into Amberly. TechnicolorLife does not claim ownership of your seizure logs, notes, attachments, or exported reports. Amberly does not require or provide an account; there is no login and no TechnicolorLife-hosted profile. See the Privacy Policy for complete details on how your information is handled.

7. Acceptable use

You agree to use Amberly only for its intended purpose as a personal seizure diary. You agree not to:

  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App, except to the extent applicable law expressly prohibits such restriction.
  • Copy, modify, redistribute, sublicense, sell, rent, or lease the App or any part of it.
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notice.
  • Use the App to harm, harass, impersonate, or violate the rights of any person.
  • Use the App in any way that violates applicable local, state, national, or international law.
  • Use the App to attempt to provide clinical care or medical services to anyone other than the user of the device.

8. Intellectual property

The App, including its design, code, graphics, text, logo, and all other content (except content you create), is the property of TechnicolorLife LLC and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial use, subject to these Terms and the Apple Licensed Application EULA.

9. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, TECHNICOLORLIFE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE APP WILL BE ERROR-FREE, SECURE, ACCURATE, RELIABLE, OR UNINTERRUPTED. YOU USE THE APP AT YOUR OWN RISK.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TECHNICOLORLIFE LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, INCLUDING (WITHOUT LIMITATION) ANY MEDICAL DECISION MADE IN RELIANCE ON INFORMATION LOGGED IN OR EXPORTED FROM THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT TECHNICOLORLIFE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless TechnicolorLife LLC and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the App; (b) your violation of these Terms; or (c) your violation of any law or the rights of a third party.

12. Termination

You may stop using Amberly at any time by uninstalling it from your device. Because Amberly is local-first and has no TechnicolorLife-hosted account, there is no account for us to close — your data stays on your device and in your iCloud until you remove it.

We may suspend or discontinue the App, or any feature of it, at any time, including for users who violate these Terms. Because we have no access to your data, ending your license to use the App does not delete your data; you remain in control of the records stored on your device and in your iCloud.

13. Governing law and dispute resolution

These Terms are governed by the laws of the United States. Any dispute arising out of or relating to these Terms or the App shall be resolved in accordance with applicable law.

14. Apple-specific terms

The following provisions apply to your use of the App on Apple devices and are required by Apple:

  • Acknowledgment. These Terms are entered into between you and TechnicolorLife LLC only, and not with Apple Inc. ("Apple"). TechnicolorLife, not Apple, is solely responsible for the App and its content.
  • Scope of license. The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in Apple's App Store Terms of Service.
  • Maintenance and support. TechnicolorLife is solely responsible for providing any maintenance and support services for the App. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
  • Warranty. TechnicolorLife is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the App to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of TechnicolorLife.
  • Product claims. TechnicolorLife, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
  • Intellectual property. In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, TechnicolorLife, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
  • Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Developer contact information. Questions, complaints, or claims regarding the App should be directed to: contact@technicolorlife.app.
  • Third-party beneficiary. You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

15. Export controls

You agree to comply with all U.S. and foreign export laws and regulations to ensure that neither the App nor any technical data related to it is exported or re-exported directly or indirectly in violation of, or used for any purposes prohibited by, such laws and regulations.

16. Severability and entire agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy and the Apple Licensed Application EULA, constitute the entire agreement between you and TechnicolorLife regarding the App and supersede any prior agreements between you and TechnicolorLife relating to the App.

17. Changes to these Terms

We may update these Terms over time. When we do, we will update the "Last updated" date at the top of this page. If we make material changes, we will give you clear notice in the App or on technicolorlife.app before they take effect. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
